A bill has been introduced in Pennsylvania that would explicitly add windshield repair and replacement in the definition of a “Service Contract”. Under Section 358 of Pennsylvania Insurance Law, such service contracts are excluded from state insurance regulation. The bill, S 539, proposes that any contract provision that includes “repair of chips or cracks in or the replacement of motor vehicle windshields as a result of damage caused by road hazards” would be considered to be a service contract. The bill will be considered by the Senate Banking and Insurance Committee.
