AOB Bill to Be Considered in Florida Again

December 10, 2021

Florida Senator Linda Stewart has pre-filed Assignment of Benefits (AOB) legislation in advance of the upcoming 2022 Legislative Session. Senator Stewart had introduced legislation last year but her bill did not move beyond committee consideration.

The pre-filed bill, S 484, would add a provision to Florida law that prohibits a motor vehicle repair shop to “offer to a customer a rebate, gift, gift card, cash, coupon, or any other things of value in exchange for making an insurance claim for motor vehicle glass replacement or repair, including an offer made through a nonemployee who is compensated for the solicitation of insurance claims”.

The proposal, as pre-filed, does not include provision regarding calibration that was in last year’s version of the bill.

The bill has been assigned to three Senate Committees: Banking and Insurance; Commerce and Tourism; and, Rules.
