Amended ADAS Bill Passes New Hampshire House Committee

The New Hampshire House Commerce and Consumer Protection has advanced HB 1455, legislation addressing Advanced Driver Automobile System calibrations, with an amendment. The amendment establishes a rebuttable presumption that manufacturer recommendations for scans and calibrations are necessary for vehicle safety and for restoration of a vehicle to its pre-loss condition, and makes it an unfair insurance practice for an insurer company, agent, or adjuster to knowingly fail to pay a claim to the claimant or repairer to the extent the claimant’s vehicle is repaired in conformance with applicable manufacturer’s recommendations or specifications. The remainder of the bill language, regarding information that the repairer is required to provide to consumers and the repairer’s right to use their own tools and equipment as long as they meet or exceed OEM recommendations, remains intact. Additionally, the Senate version of the bill, SB 513, remains in the Senate Commerce Committee and has not been amended.
